Ft. Lauderdale Jury Awards Over $3 Million in Secondhand Asbestos Exposure Case

After six hours of deliberation, a Broward County Jury has awarded a 57 year old woman and her husband $3,606,000 in a secondhand asbestos exposure case.

Lynda and Michael Daly claimed that Mrs. Daly’s mesothelioma was a result of her secondhand exposure to asbestos-containing brakes manufactured by Ford Motor Co. and Pneumo Abex. Abex made no offer to settle the case. Lynda was diagnosed in May of 2007 and has been a resident of Broward County since 1998.

Juan P. Bauta, II and Case Dam of the Ferraro Law Firm tried the case for over three weeks against Ford and Abex. Mrs. Daly’s exposure to asbestos-containing car brakes occurred in the 1970s and 1980s when she worked, for approximately two years, at two Ford dealerships in Wisconsin. Additionally, Mrs. Daly assisted her husband with brake repair work on their personal vehicles during this same period of time. Bauta said, “Remarkably Ford and Abex continue to argue that although asbestos is clearly deadly, they are not responsible.” Although Mrs. Daly’s diagnosis was disputed by the defendants, the Jury rejected the testimony of the defense experts and relied instead on the treating physicians from Northwest Regional Hospital in Margate, FL, Brigham and Women’s Hospital in Boston, MA and Dr. Timothy Aliff of Coral Springs, FL all of whom confirmed the diagnosis.
