A magistrate court sitting in the Malawi commercial capital of Blantyre on Wednesday charged two alleged gay-lovers with three counts of indecent act, immoral behavior and sexual intercourse against the order of nature.
Presiding magistrate Usiwa Usiwa told the jam-packed court that the two alleged gay persons were the first to appear before the courts with such offenses.
“The court will therefore adjourn for some days in order to allow the prosecutor to investigate more into the matter before we come up with a ruling,” he said.
He adjourned the case to January 4 for hearing.
Earlier, the lawyer representing the two accused, Mauya Msukwa, said the police rushed to arrest the two without gathering enough evidence.
He said the two were exercising their fundamental human rights by expressing their sexual orientation because Malawi is a democratic nation.
“We therefore request the court and the police to come up with balanced evidence and consider human rights issues when coming up with the ruling,” he said.
However, the couple attracted thousands of curious on-lookers in the commercial city of Blantyre when they entered the court clad in their engagement dresses.
