A federal grand jury in San Francisco has returned an indictment against the current president of HannStar Display Corporation for his participation in a global conspiracy to fix prices of thin-film transistor liquid crystal display (TFT-LCD) panels.

The indictment, filed in U.S. District Court in San Francisco, charges that Ding Hui Joe, aka David Joe, conspired with others to suppress and eliminate competition by fixing the prices of TFT-LCD panels. Joe, a resident of Taiwan, is charged with participating in the conspiracy from on or about Sept. 14, 2001, until on or about Jan. 31, 2006.

TFT-LCD panels are used in computer monitors and notebooks, televisions, mobile phones and other electronic devices. By the end of the conspiracy period, the worldwide market for TFT-LCD panels was valued at $70 billion. Companies directly affected by the LCD price-fixing conspiracy are some of the largest computer and television manufacturers in the world, including Apple, Dell and Hewlett Packard.

According to the one-count felony charge, Joe participated in the conspiracy by agreeing to fix prices of TFT-LCD panels during secret meetings, referred to as “Crystal Meetings,” in hotel rooms in Taipei, Taiwan. The participants in the conspiracy also exchanged information on the sales of TFT-LCD panels for the purpose of monitoring and enforcing adherence to the agreed-upon prices. According to the court document, in order to keep the meetings secret and avoid detection, the participants took various steps to conceal the conspiracy.

As a result of this investigation, more than $890 million in criminal fines have been obtained to date. Including this indictment, 22 executives and eight companies have been charged in the department’s ongoing investigation into price fixing in the LCD industry.

Joe is charged with price fixing in violation of the Sherman Act, which carries a maximum penalty of 10 years in prison and a $1 million fine for individuals. The maximum fine may be increased to twice the gain derived from the crime or twice the loss suffered by the victims, if either of those amounts is greater than the statutory maximum fine.

An indictment contains merely allegations, and the defendant is presumed innocent unless proven guilty in a court of law.

The charge is the result of a joint investigation by the Department of Justice Antitrust Division’s San Francisco Field Office and the FBI in San Francisco.

Anyone with information concerning illegal conduct in the TFT-LCD industry is urged to call the Antitrust Division’s San Francisco Field Office at 415-436-6660 or visit www.justice.gov/atr/contact/newcase.htm.

An Atlanta grand jury has returned an indictment against an executive of Martinair Holland N.V. for participating in a conspiracy to fix and coordinate certain surcharges on air cargo shipments to and from the United States.

The indictment, returned in U.S. District Court in Atlanta, charges Maria Christina “Meta” Ullings, senior vice president of Cargo Sales and Marketing of Martinair based in Amsterdam, with conspiring with others to suppress and eliminate competition by fixing and coordinating certain surcharges, including fuel surcharges, charged to customers located in the United States and elsewhere for international air shipments to and from the United States from at least as early as January 2001 until at least February 2006.

Air cargo carriers transport a variety of cargo shipments, such as heavy equipment, perishable commodities and consumer goods, on scheduled international flights.

According to the indictment, Ullings and co-conspirators carried out the conspiracy by communicating and agreeing upon certain surcharges to be charged for shipments to and from the United States. As part of the conspiracy, Ullings and co-conspirators monitored the surcharge agreements and accepted payments at noncompetitive rates.

Ullings is charged with price fixing in violation of the Sherman Act, which carries a maximum penalty of 10 years in prison and a $1 million fine. The maximum fine may be increased to twice the gain derived from the crime or twice the loss suffered by the victims of the crime, if either of those amounts is greater than the statutory maximum fine.

A total of 17 airlines and eight executives, including Ullings, have been charged in the Justice Department’s ongoing investigation into price fixing in the air transportation industry. To date, more than $1.6 billion in criminal fines have been imposed and four executives have been sentenced to serve prison time. Charges are pending against four executives, including Ullings.

The airlines that have pleaded guilty, or have agreed to plead guilty, as a result of the department’s ongoing investigation into the air transportation industry are: British Airways Plc, Korean Air Lines Co. Ltd., Qantas Airways Limited, Japan Airlines International Co. Ltd., Martinair Holland N.V., Cathay Pacific Airways Limited, SAS Cargo Group A/S, Société Air France, Koninklijke Luchtvaart Maatschappij N.V. (KLM Royal Dutch Airlines), EL AL Israel Airlines Ltd., LAN Cargo S.A., Aerolinhas Brasileiras S.A., Cargolux Airlines International S.A., Nippon Cargo Airlines Co. Ltd., Northwest Airlines LLC and Asiana Airlines Inc. Additionally, on Sept. 2, 2010, Polar Air Cargo LLC was charged in this investigation and is scheduled to enter a guilty plea and be sentenced on Oct. 15, 2010.

Airline executives who have pleaded guilty as a result of the investigation are Bruce McCaffrey of Qantas, Keith Packer of British Airways, Franciscus Johannes de Jong of Martinair and Timothy Pfeil of SAS Cargo. On Aug. 12, 2009, Jan Lillieborg, a citizen and resident of Sweden and former vice president of global sales for SAS Cargo, was indicted for participating in a conspiracy to suppress and eliminate competition by allocating customers and coordinating surcharge increases for international air shipments to and from the United States. On Aug. 26, 2010, Joo Ahn Kang, former president of Asiana, and Chung Sik Kwak, former vice president of the Americas region of Asiana, both citizens and residents of the Republic of Korea, were indicted for participating in a conspiracy to suppress and eliminate competition by fixing passenger airfares for travel between the United States and Korea. Trial dates have yet to be scheduled for these individuals.

The charge is the result of a joint investigation into the air transportation industry being conducted by the Antitrust Division’s National Criminal Enforcement Section, the FBI’s Washington Field Office, the Department of Transportation’s Office of Inspector General and the U.S. Postal Service’s Office of Inspector General. Anyone with information concerning price fixing or other anticompetitive conduct in the air transportation industry is urged to call the Antitrust Division’s National Criminal Enforcement Section at 202-307-6694 or visit www.justice.gov/atr/contact/newcase.htm, or call the FBI’s Washington Field Office at 202-278-2000.

The AU Commission intends, through this initiative, to collect in absolute transparency all financial contributions of member states wishing to express their active solidarity towards Haiti which is considered by the AU as the sixth region of Africa,” Ping said at the opening of the 19th Ordinary Session of the AU Permanent Representatives’ Committee (PRC) on Monday in Addis.

Describing the earthquake in Haiti as an “unusual” disaster, the AU Commission chairman also urged African groups working in international organizations and Africans in the Diaspora to continue ’’the massive support effort’’ to Haiti, noting that many member states have endorsed this effort through cash donations.

He also recalled the various initiatives already taken by the AU Commission for the earthquake victims mainly through support messages and calls on member states and the AU delegations in major world capitals.

The PRC session, preparing for the 14th AU summit scheduled for 31 January to 2 February, include the African ambassadors accredited to Addis Ababa on the theme ’’Information and Communication Technologies in Africa : Challenges and Prospects for Development.’’

The PRC meeting will be followed by the 16th Ordinary Session of the AU Executive Council (Foreign ministers) on 28-29 January.

PAZA, an organization for journalists working for public and government media, has has been collaborating with other journalists associations — including those from the private media in opposing the proposed law.

Due to this the government has accused the PAZA executive of having received bribes from some private media in order to oppose the proposed media law.

But PAZA president Andrew Sakala told journalists on Thursday that his association took great exception to the accusations by government.

He also rejected government suggestions that the PAZA executive was in office illegally as the association because of allegations of failing to organize an Annual General Meeting at which new office bearers should be elected.

Sakala said his executive was not clinging to office as alleged by government and neither had it received any bribes apart from signing Memorandums of Understanding with other journalists organizations for mutual co-operation.

He said it was wrong for government to politicize the operations of PAZA, just because the association was opposed to the proposed media law.

And the Southern African Journalists Association (SAJA) said through its Treasurer Morgan Chonya that it is observing the media situation in Zambia carefully.

The media law if enacted will among other things imprison or fine journalists that failed to obtain a practicing license.

To continue the theme of our (cultural?) inability to learn from past mistakes, I think it is important to remember that we learn in order to get on successfully in a world that initially strikes us as the “blooming, buzzing confusion” described in Chapter XIII of William James’ The Principles of Psychology. From this point of view, we are best informed by that sentence in Henry Miller’s Tropic of Capricorn: “Confusion is a word we have invented for an order which is not understood.” Ever since James we have tried to deal with how our mind deals with confusion by seeking patterns through which it may “understand,” in Miller’s sense of the word, an order that must be present.

An excellent example of such pattern-seeking behavior may be found in the column John Kay wrote yesterday for the Financial Times under the title “The Cause of our Crises has not Gone Away.” Given where the column was published, one quickly recognizes that the “crises” he has in mind are economic, rather than matters of ethics or “homeland security.” The logical strategy of his article involved situating current conditions in a historical context and then seeking out patterns in that broader historical view. His results are, to say the least, striking:

The credit crunch of 2007-08 was the third phase of a larger and longer financial crisis. The first phase was the emerging market defaults of the 1990s. The second was the new economy boom and bust at the turn of the century. The third was the collapse of markets for structured debt products, which had grown so rapidly in the five years up to 2007.

The manifestation of the problem in each phase was different – first emerging markets, then stock markets, then debt. But the mechanics were essentially the same. Financial institutions identified a genuine economic change – the assimilation of some poor countries into the global economy, the opportunities offered to business by new information technology, and the development of opportunities to manage risk and maturity mismatch more effectively through markets. Competition to sell products led to wild exaggeration of the pace and scope of these trends. The resulting herd enthusiasm led to mispricing – particularly in asset markets, which yielded large, and largely illusory, profits, of which a substantial fraction was paid to employees.

Eventually, at the end of each phase, reality impinged. The activities that once seemed so profitable – funding the financial systems of emerging economies, promoting start-up internet businesses, trading in structured debt products – turned out, in fact, to have been a source of losses. Lenders had to make write-offs, most of the new economy stocks proved valueless and many structured products became unmarketable. Governments, and particularly the US government, reacted on each occasion by pumping money into the financial system in the hope of staving off wider collapse, with some degree of success. At the end of each phase, regulators and financial institutions declared that lessons had been learnt. While measures were implemented which, if they had been introduced five years earlier, might have prevented the most recent crisis from taking the particular form it did, these responses addressed the particular problem that had just occurred, rather than the underlying generic problems of skewed incentives and dysfunctional institutional structures.

The public support of markets provided on each occasion the fuel needed to stoke the next crisis. Each boom and bust is larger than the last. Since the alleviating action is also larger, the pattern is one of cycles of increasing amplitude.

There are two important conclusions to draw from these findings. The first is that, informed by a historical view, Kay concluded that the pattern resides not in the structure of the crises themselves but in “mechanics” that were repeated from one crisis to the next. The second is that each iteration of those “mechanics” leads to a crisis whose amplitude is greater than its predecessor.

Kay’s conclusion is likely to aggravate just about everyone trying to make a living in the financial sector, with the possible exception of those who sail under the flag of what I have called “the Grameen School of thought,” whose fundamental premise is that the financial sector should be based on a non-profit business model. His final sentence packs a real wallop:

In the name of free markets, we created a monster that threatens to destroy the very free markets we extol.

The nature of that monster is best captured by his brief speculation on how the next crisis might surface:

I do not know what the epicentre of the next crisis will be, except that it is unlikely to involve structured debt products. I do know that unless human nature changes or there is fundamental change in the structure of the financial services industry – equally improbable – there will be another manifestation once again based on naive extrapolation and collective magical thinking.

In other words the entire financial sector rests on a foundation of illusion; and, while Niall Ferguson argued that case that such illusion was a necessary prerequisite for progress, Robert Skidelsky saw it as a sign of regress in the development of a society more ingenious at making money than at making things. To bring this distinction to Main Street, the very fact that our financial institutions have, for all intents and purposes, “recovered” from the crisis while the resulting unemployment crisis shows no similar signs of recovery can be attributed to the proposition that ours is no longer a country with a significant commitment to “making things.” Furthermore, we cannot expect either the Executive or Legislative branches of government to confront this problem, because ours is an age in which those who make money have radically more influence than those who make things. From this point of view, the financial sector may very well barrel its way into its next crisis before the rest of the country has recovered from the present one!

The governors, who met under the auspices of the PDP Governors’ Forum, said the president had spoken by telephone to key members of the government, including those in the legislature and the executive.

The Chairman of the Forum, Governor Olusola Saraki of Kwara State said after the meeting that the health of the president was being politicized and urged mischief makers to desist.

He said it was uncharitable to make the ailment of the president a political issue and he urged Nigerians to have confidence that the country had not slid backwards.

The governor said that the forum also flayed the attempt by a Nigerian to bomb a US airline but was unhappy with the action the government of the United States took, especially the classification of Nigeria as a country to watch in terrorism.

Meanwhile, the Nigerian Bar Association (NBA) and a human rights activist, Femi Falana, appeared before the Abuja High Court on Tuesday to ask the court to force the president to resign.

The case was heard briefly and the court gave the government’s counsel time to respond but no date had been fixed for the hearing.

Liberian President Ellen Johnson Sirleaf has issued Executive Order #22, a Whistleblower Act, which is intended to protect anyone who discloses information about actions of impropriety against the public interest or public good that is occurring, has occurred, or will occur in any public or private institution.

According to a Presidential Mansion press statement issued Tuesday, the objective of the Executive Order is to protect persons employed in both public and private institutions who disclose information about action against the public interest or good in any public or private institution, unless otherwise provided by law, to allow individuals the right to take legal action in respect of retaliation and related matters.

The Executive Order applies to any protected public interest disclosure which is made after the date on which the Executive Order comes into operation. The Order binds all persons, including the state, the statement said.

“Public interest disclosure” in this sense means specific disclosure by an individual involving illegality, criminality, breach of law, miscarriage of justice, danger to public health and safety and damage to the environment and includes attempt to cover up such malpractices in any governmental establishment, public or private enterprise.

The Whistleblower Act is to be submitted to the Liberian legislature for passage into law.

The Order notes the importance of protecting the Liberian society against the continued acts of impropriety and other practices that will continue to seriously impact negatively upon the nation.

Under the Executive Order, a whistleblower who meets the criteria set forth and acting in good faith, shall not be subjected to retaliatory action by the employer, by a fellow employee or by another person because a disclosure has been made.

Retaliation, under conditions of the Executive Order, is unlawful and is an indictable offense where the person making the disclosure has acted within the law, met the criteria of the Executive Order and acted in good faith.

Accordingly, an employer or person retaliating against a person who is properly making a public interest disclosure, commits an offense punishable by a maximum penalty of two years, in the category as defined by the Penal Law of Liberia.

Executive Order #22, further states that a whistleblower who has suffered retaliation under provisions of the Order, can seek redress according to the form of the retaliation suffered – if criminal, from the Ministry of Justice ; if employment-based, from the Ministry of Labor ; if economic, from the civil courts through an action in damages.

The Togolese authorities have now decided to expel Eric Bosc, first secretary of the French embassy in Lome, who was responsible for monitoring the politics of the country.

It is alleged that the French diplomat has close relations with Kofi Yamgnane former mayor of St. Coulitz in Brittany, France.

France supports its diplomat whose “professionalism is acknowledged”. It took a reciprocal step and requested the departure of a diplomat from the Togolese embassy in Paris.

“Eric Bosc is a long-time friend,” Yamgnane said.

“His expulsion is meaningless, this is evidence that the executive is panicking,” he added.

He also revealed that everything is done in Togo to prevent him from meeting people, going to villages and prefectures.

“When my candidacy was announced, they laughed but they see the danger as we go and today it’s panic all around in the ruling party ahead of the 2010 presidential election,” said Kofi Yamgnane, denying reports of his arrest in Lome.

Aged 64, Kofi Yamgnane, was also secretary of state in France under François Mitterrand.

He noted that the on-going electoral reform was the panacea to the social ills of the country.

Yar’Adua, who was represented by Vice President Goodluck Jonathan, urged the National Assembly to redouble its efforts in the process of amending the 1999 constitution and the Electoral Act.

The President had on assumption of office in May 2007 said that the election that brought him into power was faulty and set up a panel to review the electoral system.

The panel headed by a retired Chief Justice of the Federation, Justice Mohammed Uwais, had submitted its report with remarkable changes to the Act and the Constitution which have assumed issues for national debate.

The President gave the assurance that the government would support the National Assembly’s effort to amend the 1999 Constitution and the Electoral Act.

Yar’Adua urged the Legislators to support the Executive in the fight against corruption, poverty, infrastructure deficit, insecurity and unemployment.

Earlier in his welcome address, the Senate President, Sen. David Mark, said the retreat was organised for self appraisal and to consider issues which needed urgent legislative attentions.

Warner told journalists on Monday in Abuja that FIFA had established “independent clinics for emergency assessment and intensive care of critically ill patients’’ at all eight cities hosting the tournament.

The cities are Abuja, Enugu, Bauchi, Kano, Kaduna, Calabar, Lagos and Ijebu-Ode.

Warner urged Nigeria to maintain the facilities well and put them to good use.

“I plead with all Nigerians to put these facilities to good use and to also make sure that they are well maintained.

“Between 1999 and 2009, I have visited Nigeria 24 times and the facilities we left behind after Nigeria ’99 were not put to proper use. So these ones should not be so,” he added.

Warner explained that a FIFA Medical Centre of Excellence at the University of Witwatersrand (Johannesburg) held a course on medical emergencies in football on Octpber 20 and October 21 in Abuja.

“The course covered aspects of mass gatherings and disaster medicine, as well as football injuries and medical conditions that may become emergencies.

“We had Nigerian physiotherapists, team doctors and all other medical personnel representing the various professional and amateur club sides in attendance,” he said.

Warner said the course, which was based on practical procedures, also had in attendance some Nigerian medical specialists, including the medical officers at each of the FIFA U-17 World Cup hosts cities.

The medical initiative, under a project called `Win Africa with Africa’, first emerged on May 15, 2004 when FIFA Executive Committee chose South Africa to host the 2010 FIFA World Cup.

The Department of Justice has announced that two detainees have been transferred from the detention facility at Guantanamo Bay to the control of the governments of Kuwait and Belgium.

As directed by the President’s Jan. 22, 2009 Executive Order, the interagency Guantanamo Review Task Force conducted a comprehensive review of each of these cases. As a result of that review, these detainees were approved for transfer from Guantanamo Bay. In accordance with Congressionally-mandated reporting requirements, the Administration informed Congress of its intent to transfer each of these detainees at least 15 days in advance.

Khalid Abdullah Mishal al Mutairi, a native of Kuwait, was transferred to the Government of Kuwait. On July 29, 2009, a federal court ruled that al Mutairi may no longer be detained under the Authorization for the Use of Military Force (AUMF) and ordered the government to release him from detention at Guantanamo Bay.

Another detainee was transferred from Guantanamo Bay to the Government of Belgium. Pursuant to a request from the Government of Belgium, the identity of this individual is being withheld for privacy reasons.

These transfers were carried out under individual arrangements between the United States and the governments of Kuwait and Belgium. The United States has coordinated with the governments of each of these nations to ensure the transfers take place under appropriate security measures and will continue to consult with these governments regarding these matters.

Since 2002, more than 550 detainees have departed Guantanamo for other countries including Albania, Algeria, Afghanistan, Australia, Bangladesh, Bahrain, Belgium, Bermuda, Chad, Denmark, Egypt, France, Iran, Iraq, Jordan, Kuwait, Libya, Maldives, Mauritania, Morocco, Pakistan, Portugal, Russia, Saudi Arabia, Spain, Sweden, Sudan, Tajikistan, Turkey, Uganda, United Kingdom and Yemen.
